What: Reps. Dana Rohrabacher (R-CA) and William Delahunt (D-MA) will be leading a press conference to announce a bipartisan letter to the U.S. Pardon Attorney asking for commutation of sentence for unjustly imprisoned Border Patrol Agents Ignacio Ramos and Jose Compean. The agents are currently serving 11 and 12 year prison sentences, respectively, for shooting and wounding a self -admitted illegal alien drug smuggler. Both men have already spent almost two years in solitary confinement. Thus far, eighty-two Members of Congress, representing the entire political spectrum, have signed on to H.Con. Res 267 in support of commutation.

Members will discuss the injustices of the case, as well as, the misapplication of 18 U.S.C. 924(c), “the unlawful discharge of a firearm in commission of a crime of violence,” which placed a mandatory minimum 10 year sentence onto the agents’ convictions.

“Many patriotic Americans are dismayed by the continued persecution and legal torture of former Border Patrol officers Ramos and Compean. The legal establishment has obviously taken its directives from senior levels of the Bush Administration.

“All decent Americans are now calling on President Bush to show some mercy towards these unjustly convicted men who never should have been prosecuted in the first place.

EL PASO, Texas — A former Border Patrol agent convicted of shooting a fleeing drug smuggler was resentenced to his original 12-year prison term Wednesday, the U.S. Attorney's Office said.

A federal judge in El Paso resentenced Jose Alonso Compean to 10 years in prison for his conviction on a charge of using a weapon in the commission of a felony and another two years for assault and other charges, the U.S. Attorney's Office said. Read more

This was a case of aggravated perjury by not only the witnesses who testified under immunity from prosecution but also under the threat of indictment by the prosecutors. The prosecutors also committed perjury but the real killer was when the government admitted at our Appeal in New Orleans that the illegal alien and admitted drug smuggler had also told some lies as a key witness for the government at the trial. denied the request for a new hearing by Nacho Ramos and Jose Compean.

The same court upheld their convictions in July, and offered
no reason for the denial for a new hearing this past Wednesday,
but one thing is certain...

the only way Nacho and Jose will see their children
before they are grown, is if grassroots America gets
involved.

I don't mean just signing a petition, or sending a fax.

It's more than that. I need you to be passionately involved--
making the Ramos and Compean plight your own, and committing
to doing whatever it takes to return them
as free men to their families!

On October 4th, 2008 RAIA Southwest will be sponsoring a benefit rally for wrongfully imprisoned border patrol agents Ramos and Compean.

In 2005, during a failed drug smuggling attempt these men were involved in a shooting resulting in the wounding of an admitted drug runner from Mexico. For doing their jobs, defending our border, and capturing a van loaded with over 700 pounds of marijuana, these agents were sent to federal prison for 11 and 12 years.

Nacho Ramos and wife, MonicaJoin us in assisting their families.

Registration for the run is from 7 to 10am at Tosos Sports Bar & Grill, 2401 W. Union Hills Drive. Admission is free, but we are asking for donations to help the Ramos and Compean families. There will be breakfast provided at no charge.

The run will leave promptly at 10am. We will ride to the state capitol at 17th Ave and Jefferson for surprise guest speakers. Once the speakers have finished there will be a road march of bikes and cars heading up I-17. We will ride past the federal prison at the Pioneer Rd exit where Nacho Ramos is currently being held.

The ride will end at the Roadrunner Saloon in New River. Live music, raffles, vendors, and discounted food will be provided.

More information will be released soon. Everyone is welcome and encouraged to attend.

The families of the imprisoned Border Patrol agents are in dire need of financial support. They have lost homes, incurred large medical bills due to lack of insurance, cashed out retirement accounts, and the children of the agents have endured taunting by unsympathetic neighbors, among other things. 28 days after a Federal Judge ruled that Caltrans did "irreparable harm" to the Constitutional rights of the San Diego Minutemen by unlawfully revoking our legal adopt-a-highway permit, thereby squelching our free speech, Caltrans finally put our sign back up today that they had ripped out of the ground literally in the middle of the night on Jan. 28th.
We are all thrilled to see our adopt-a-highway recognition sign back up standing more proudly than ever. The U.S. Constitution has thankfully trumped the lies and coercion of the illegal alien activists and the corrupt California Mexican Caucus, especially Assemblymember Lori Saldana who joined forces with Enrique Morones late last year to wage a destruction crusade against the fine, multi-ethnic Patriots of the San Diego Minutemen. Her malicious lies have been exposed for the judge and the world to see!
Judge Hayes also saw clear evidence that even the Mexican Government, via their Consulate in San Diego and agents like Morones who works for the Mexican Govt., put pressure on Caltrans to violate their own rules and the American Constitution, which District Director Pedro Delgado and Director Will Kempton then caved in to (see attachment).
We've all won a huge battle against the open border reconquistas and their agents in elected office, but the war is not over. Caltrans has still not given us our second AAH site on southbound I-5 that they unlawfully denied to us on May 15th. They are obviously still trying to please Saldana, Gil Cedillo and their ilk rather than follow their own written regulations and the LAW! We will be asking them one more time, nicely to give us that site or we will haul them back into Federal Court where will again hold them accountable for their deeds.
Also, the entire program is still suspended for new applicants while they continue to attempt to rewrite their regulations to exclude pro-law enforcement and border security groups from participating. That will never pass Constitution muster either. They are just wasting time and millions of precious taxpayer dollars. This long suspension is also leaving many California highways uncleaned or having to hire work crews to clean them. Gov. Schwarzenegger needs to get control of our state now, before the pro-alien liberals and special interest groups in Sacramento destroy it completely.

We dedicate this adopted freeway site to Border Patrol Agents Nacho Ramos and Jose Compean who are still fighting for their rights and freedoms that were stripped from them by corrupt Federal Government forces in the George W. Bush Administration.

Judicial Watch Sues State Department to Obtain Documents Related to Jailed Border Patrol Agents

Regular readers of the Weekly Update will remember the names Ignacio "Nacho" Ramos and Jose Alonso Compean. They are the two Border Patrol agents shamelessly prosecuted by the U.S. government for shooting and wounding a Mexican drug smuggler, Oswald Aldrete-Davila, on February 17, 2005. (The two Border Patrol agents were sentenced to 11 and 12 years respectively. Aldrete-Davila, who attempted to smuggle 750 pounds of marijuana into the U.S., was given medical treatment and immunity for his testimony.)

Well, on June 12 Judicial Watched filed a lawsuit against the Department of State to obtain documents related to the government's decision to prosecute Ramos and Compean and to strike a deal with Aldrete-Davila for his testimony. Judicial Watch filed its original FOIA request on April 17, 2008. The government failed to respond within the statutory 20-day period, forcing us to file our lawsuit.

(Incidentally, this is the second FOIA lawsuit filed by Judicial Watch related to the jailed Border Patrol agents. Click here for more information.)

Here's essentially what we're after in this lawsuit.
  • Information pertaining to government deals that were made with the government of Mexico to bring Aldrete-Davila to the U.S. to testify.
  • Any internal communications between the State Department, the Department of Homeland Security and the Justice Department related to the decision to permit the lawful entry of Aldrete-Davila into the U.S. for medical treatment and for meetings with government prosecutors.
  • Any and all records of the Diplomatic Security Services (a branch of the State Department) related to the shooting incident.
There is enormous public interest in this incident. Many people, myself included, suspect these Border Patrol Agents were railroaded by the government for simply doing their jobs. Given the controversy surrounding the case, the more the American people know, the better.

We continue to aggressively pursue documents related to the incident, and I will keep you posted on what we find.

LAWMAKERS JOIN JONES TO REQUEST INVESTIGATION OF PROSECUTOR IN BORDER AGENTS CASE Complaint of Prosecutorial Misconduct Filed Against U.S. Attorney Johnny Sutton Washington, D.C. –

In a letter this week to the U.S. Department of Justice, Representative Walter B. Jones (R-NC) – joined by Reps. Ted Poe (R-TX), Virgil Goode (R-VA), Louie Gohmert (R-TX), John Culberson (R-TX), Dana Rohrabacher (R-CA) and Don Manzullo (R-IL)

– requested that the Office of Professional Responsibility investigate the actions of U.S. Attorney Johnny Sutton in the prosecution of U.S. Border Patrol agents Ignacio Ramos and Jose Alonso Compean.
The agents entered federal prison on January 17, 2007, to begin serving sentences of 11 and 12 years respectively for shooting and wounding a Mexican drug smuggler who brought 743 pounds of marijuana across the U.S. border in 2005. Excerpts from the letter follow below.

“As Members of Congress, we write this letter to bring to your attention for investigation what we have concluded to be a serious miscarriage of justice by United States Attorney Johnny Sutton. Mr. Sutton supervised, and has vigorously defended, his office’s actions in a case wherein two United States Border Patrol agents – Ignacio Ramos and Jose Alonso Compean — have been convicted, and each are now being punished by imprisonment of 10 years, for a crime that does not exist, and therefore, for a crime that could not have been committed.” “Specifically, Mr. Ramos and Mr. Compean were charged with violating 18 United States Code Section 924(c)(1)(A) by the ‘knowing[] discharge[] [of] a firearm ... during and in relation to a crime of violence.’ (Emphasis added). There is, however, no such crime. Rather, Section 924(c)(1)(A) makes it a crime to ‘use or carry ... during and in relation to any crime of violence’ or to ‘possess a firearm’ ‘in furtherance of’ any such crime.

And, as the United States Supreme Court recently pointed out, ‘discharge’ is only a sentencing factor to be considered by the judge after conviction, not by the jury in the effort to determine whether the law has been violated. United States v. Watson …(2007).”
“United States Attorney Sutton secured an indictment charging Mr. Ramos and Mr. Compean with the non-existent crime of ‘discharging’ a firearm ‘in relation to a crime of violence.’

By this charge Mr. Sutton facilitated the conviction of the two border control agents by means of jury instructions that focused the jury’s attention upon the ‘discharge’ of the agents’ firearms, rather than upon the lawfulness of the possession, carrying, and use of such firearms in the ordinary course of their employment. Moreover, by this indictment and these instructions,

Mr. Sutton obtained a conviction of an offense that carried a minimum 10-year sentence, as provided by the statute, rather than the lesser-sentence for violation of Border Patrol rules and regulations.”


“It is our firm conviction that, by these actions, Mr. Sutton is guilty of prosecutorial misconduct, which has imposed an irreversible and substantial effect upon Mr. Ramos and Mr. Compean and their families. Prior to the return of the indictment against Mr. Ramos and Mr. Compean,

Mr. Sutton must have known that it was impossible for there to be probable cause for a ‘crime’ never enacted by Congress, as authoritatively and previously decided by the United States Supreme Court and the United States Court of Appeals for the Fifth Circuit.

According to Rule 3.09 of the Texas Disciplinary Rules of Professional Conduct, a prosecuting attorney is to ‘refrain from prosecuting ... a charge that the prosecutor knows is not supported by probable cause.’”


“Mr. Sutton has manipulated the federal criminal code to obtain a conviction against two U.S. Border Patrol agents, preferring to win at all costs over his duty as a United States Attorney, and his duty under the Texas Rules of Professional Conduct. This is a matter which your office has a duty to investigate and, on the basis of what we now know, to remedy.”

Though he is sworn to protect the American people, U.S. Attorney Johnny Sutton has been operating more as an agent for George Bush and the corrupt Mexican government, than as an advocate for the American people. Since taking office, Sutton has been persecuting American law enforcement officers when they dare to defend our border or block the path of drug smugglers. It could be easily argued that Sutton´s actions through his position as a U.S. Attorney, are contributing to the growing violence being perpetrated by drug gangs on both sides of the border.
