Congressional Hearing

**Congressional Hearing - scheduled to go forward after the 4th of July - Prosecutor Misconduct Filed Against U.S. Attorney Johnny Sutton http://jones.house.gov/release.cfm?id=689

Congressman Walter Jones
For Immediate Release Thursday, June 19, 2008 Contact: Kathleen M. Joyce 202-225-3415 http://jones.house.gov/release.cfm?id=689

LAWMAKERS JOIN JONES TO REQUEST INVESTIGATION OF PROSECUTOR IN BORDER AGENTS CASE Complaint of Prosecutorial Misconduct Filed Against U.S. Attorney Johnny Sutton Washington, D.C. –

In a letter this week to the U.S. Department of Justice, Representative Walter B. Jones (R-NC) – joined by Reps. Ted Poe (R-TX), Virgil Goode (R-VA), Louie Gohmert (R-TX), John Culberson (R-TX), Dana Rohrabacher (R-CA) and Don Manzullo (R-IL)

– requested that the Office of Professional Responsibility investigate the actions of U.S. Attorney Johnny Sutton in the prosecution of U.S. Border Patrol agents Ignacio Ramos and Jose Alonso Compean.
The agents entered federal prison on January 17, 2007, to begin serving sentences of 11 and 12 years respectively for shooting and wounding a Mexican drug smuggler who brought 743 pounds of marijuana across the U.S. border in 2005. Excerpts from the letter follow below.

“As Members of Congress, we write this letter to bring to your attention for investigation what we have concluded to be a serious miscarriage of justice by United States Attorney Johnny Sutton. Mr. Sutton supervised, and has vigorously defended, his office’s actions in a case wherein two United States Border Patrol agents – Ignacio Ramos and Jose Alonso Compean — have been convicted, and each are now being punished by imprisonment of 10 years, for a crime that does not exist, and therefore, for a crime that could not have been committed.” “Specifically, Mr. Ramos and Mr. Compean were charged with violating 18 United States Code Section 924(c)(1)(A) by the ‘knowing[] discharge[] [of] a firearm ... during and in relation to a crime of violence.’ (Emphasis added). There is, however, no such crime. Rather, Section 924(c)(1)(A) makes it a crime to ‘use or carry ... during and in relation to any crime of violence’ or to ‘possess a firearm’ ‘in furtherance of’ any such crime.

And, as the United States Supreme Court recently pointed out, ‘discharge’ is only a sentencing factor to be considered by the judge after conviction, not by the jury in the effort to determine whether the law has been violated. United States v. Watson …(2007).”
“United States Attorney Sutton secured an indictment charging Mr. Ramos and Mr. Compean with the non-existent crime of ‘discharging’ a firearm ‘in relation to a crime of violence.’

By this charge Mr. Sutton facilitated the conviction of the two border control agents by means of jury instructions that focused the jury’s attention upon the ‘discharge’ of the agents’ firearms, rather than upon the lawfulness of the possession, carrying, and use of such firearms in the ordinary course of their employment. Moreover, by this indictment and these instructions,

Mr. Sutton obtained a conviction of an offense that carried a minimum 10-year sentence, as provided by the statute, rather than the lesser-sentence for violation of Border Patrol rules and regulations.”

“It is our firm conviction that, by these actions, Mr. Sutton is guilty of prosecutorial misconduct, which has imposed an irreversible and substantial effect upon Mr. Ramos and Mr. Compean and their families. Prior to the return of the indictment against Mr. Ramos and Mr. Compean,

Mr. Sutton must have known that it was impossible for there to be probable cause for a ‘crime’ never enacted by Congress, as authoritatively and previously decided by the United States Supreme Court and the United States Court of Appeals for the Fifth Circuit.

According to Rule 3.09 of the Texas Disciplinary Rules of Professional Conduct, a prosecuting attorney is to ‘refrain from prosecuting ... a charge that the prosecutor knows is not supported by probable cause.’”

“Mr. Sutton has manipulated the federal criminal code to obtain a conviction against two U.S. Border Patrol agents, preferring to win at all costs over his duty as a United States Attorney, and his duty under the Texas Rules of Professional Conduct. This is a matter which your office has a duty to investigate and, on the basis of what we now know, to remedy.”

The American People Deserve An Investigation of U.S. Attorney Johnny Sutton

Dave Gibson
June 06, 2008
Though he is sworn to protect the American people, U.S. Attorney Johnny Sutton has been operating more as an agent for George Bush and the corrupt Mexican government, than as an advocate for the American people. Since taking office, Sutton has been persecuting American law enforcement officers when they dare to defend our border or block the path of drug smugglers. It could be easily argued that Sutton´s actions through his position as a U.S. Attorney, are contributing to the growing violence being perpetrated by drug gangs on both sides of the border. Dear Mr. Dillow,
I applaud you for telling the truth about the Ramos and Compean
dilemna when so few columnists in southern California
will. Thank you so much for your interview time and tedious
details in exposing this worst of all travesties of justice.

Great article.
I talked to Congressman Rohrabacker twice about the Ramos and Compean injustice at a rally in front of his office and it does hit him personally that something like this could happen. Many congressman wont lift a finger for you if your not in their district, but Congressman Rohrabacker is one of the leaders in getting these two men released

Complicity between the El Paso prosecutors office and the corrupt government of Mexico is a traumatic experience for these to US agents. Locked in prison when all they did was stop another haul of drugs imported into our nation, for use of our kids. There is no no doubt in my mind that there is a huge cover up here, seeing that President Bush is a personal friend of Sutton

The two-tier border fence as originally drafted by Rep.Duncan Hunter (R-CA) has been undermined by Democratic House Speaker Nancy Pelosi. The American people should ask and her party members why? Why wouldn't she want to slow the movement of drugs, the gun runners, illegal immigration and the infestation of terrorists and the taxpayers traumatic expenditure to support illegal alien families. http://www.eagleforum.org/sources/ Why wouldn't the Democrats, judges, want to halt access to child pedophiles, female assaults, murders, robbers and Social security theft that do not get wide press. Why would Madam Pelosi want a poorly constructed fence of just one row or not even completing its whole length? As I understand it Democratic leaders are threatening them with alienation, from campaign contribution resources. Remember we can stop illegal immigration with this bill if enacted. The next president is going to sign a massive AMNESTY. Take into account the SAVE ACT, would strengthen state immigration laws, like the latest that qualified in South Carolina. Any activist left-wing judge, pro-illegal business entity, ethnic radical group, corporate business cartel would be overruled by this bill in Congress. The SAVE ACT (H.R.4088) has 'zero tolerance' for parasite employers or illegal immigrants and is all encompassing the whole nation. Without a job, they go home by self-deportation.

Only the American can stop another AMNESTY?

This kind of story make me wonder why anyone would want to become a law enforcement officer. The people of this country need to realize that law enforcement are there as our hired guns. They go to battle for us against the kinds of people we're too affraid of confronting. Yet, these same citizens will throw law enforcement under the bus for doing the job we hired them to do. WHAT A CROCK!!!!!!!

Anyone care to read between the lines? Check the history of these agents. I once worked for a police department that was too inept to get hard core drug dealers. Eventually though one was sent to prison. Yep, for a suspended drivers license this guy went to San Quentin.

Americans need to wake up! It seems as though each day another American is unjustly charged or sentenced in favor of illegal aliens.

Thank you Mr. Dillow for writing about this case. Ramos and Compean are innocent! They were protecting our porous borders in a high drug traffic region. They were prosecuted for doing their jobs. I personally know the Ramos family and have read the transcripts and reviewed other paperwork sources. There were no errors made by Nacho Ramos - period!! Compean even filed a report and supervisors were on the scene. This was malicious prosecution by Johnny Sutton who has previously maliciously prosecuted other law enforcement and border patrol agents including Gary Brugman, Gilmer Hernandez, and Noe Aleman. Sutton has a history of protecting drug smugglers! He is the one who should be prosecuted! Free Ramos & Compean!
