Ignacio Ramos says he and his wife, Monica, and children moved to Katy because of the support they received during their legal battles. He was able to find work with the help of a supporter.

Five years ago, Ignacio Ramos was pulling long shifts as a senior U.S. Border Patrol agent, chasing smugglers and immigrants along the Rio Grande. He'd coached Little League long enough that dozens of teenagers called him “Coach Nacho.”

He and his wife, Monica, both born and raised in El Paso, were busy working and raising three boys.

Their life was, in his words, completely normal. Not boring. Just normal.

All he wants now, he says, is to have that back.

Ramos, now 40, has become a polarizing figure in the U.S. border security debate. To supporters, he is a martyr, wrongly sentenced to more than a decade in prison for doing his job — shooting at a drug smuggler he believed was threatening his partner. To critics, he and his former partner, Jose Compean, are rogue lawmen who shot a man and tried to cover it up, and caught a break when former President George W. Bush commuted their sentences amid a firestorm of publicity and public pressure.

In the 11 months since Ramos was released from federal prison, he and his family have been trying to piece their lives back together. Six months ago, they packed up their home in El Paso and moved to a four-bedroom rental home in a Katy subdivision with winding streets and cul-de-sacs and good schools.

They got jobs, put the boys back in baseball, and are trying to build new lives.

But Ramos is planning to reopen a door to the darkest chapter of his life. Within the next two months, his attorney plans to ask for a new trial.

‘Rolling the dice'

Ramos said new evidence came out while he was incarcerated that he believes would change the guilty verdict, though he said his attorney won't allow him to discuss specifics. Though Bush commuted his prison sentence, he did not offer Ramos a full pardon, and Ramos remains a convicted felon.

“I know I'm rolling the dice,” Ramos said, glancing at his wife.

“We don't go into it blind. We talk about it, and we both know the risks,” Ramos said. “And it's hard knowing what the possibility is. But it is important for me to be cleared.”

The risk, he said, is that asking for a new trial could result in prosecutors bringing new charges, though his attorney told him that was only a slim possibility.

Ramos took his chances at his first trial, saying he turned down a plea deal that offered him 18 months in prison. A federal grand jury had indicted him on seven charges and Compean on nine related to the Feb. 17, 2005, shooting of Oswaldo Aldrete Davila, an illegal immigrant from Juarez.

Aldrete, who was given immunity for his testimony against the agents, had crossed the Rio Grande and picked up a van southeast of El Paso loaded with marijuana. After a car chase toward the river, Aldrete was shot in the buttocks as he ran from the agents.

Prosecutors accused the agents of orchestrating a cover-up, charging that they never reported the shooting to superiors and made false reports, and that Compean picked up shell casings at the scene. The agents said they believed Aldrete had a weapon in his hand.

“I really believed whoever was on the jury would hear the story and would believe us, and not the story of a drug smuggler,” Ramos said.

A jury found Ramos and Compean guilty of charges including assault with a dangerous weapon and discharging of a firearm in commission of a crime of violence. In October 2006, a judge sentenced Ramos to 11 years in prison and Compean to 12.

Prosecutor defends case

Ramos started serving his time in a prison in Mississippi, but was assaulted in February 2007 and transferred to another facility in Arizona. He was put into solitary confinement for his own protection, which meant that he had no access to TV, showered three times a week, and got a monthly, 15-minute call home.

Long after the agents' convictions, the case continued to cause an uproar on talk radio and cable TV programs. Supporters, including dozens of members of Congress, called for pardons for Ramos and Compean.

Johnny Sutton, the former U.S. attorney who prosecuted the agents, defended the case, saying a jury convicted the two agents of serious crimes, and the case was “about the rule of law.”

Stays on federal record

With the conviction on his record, Ramos said he had trouble finding work in El Paso, and he worried for his family's safety. After a few months, he and Monica decided to start over in Katy, saying they were encouraged in large part by the amount of support they'd received in Houston during Ramos' legal battles.

Louise Whiteford, the president of the Houston-based organization Texans for Immigration Reform, said she and other members have participated in fundraisers for Ramos and Compean, calling the way the case was handled in the court and prison system questionable.

Monica found work here right away, but Ramos sent out dozens of applications and resumes, with no response. He finally landed a job assisting pipe fitters at a plant on Houston's east side through a supporter familiar with his case, he said.

Still, even as the family regains some normalcy, Ramos said he's compelled to try and clear his name.

“Even though there are people that believe in you, and there are people helping you, it's not easy to live with. It's very hard,” he said. “Because if you didn't know the story, ... if you just look at what's left on my record, you'd be like, ‘Oh my god, I can't leave my kids around this guy, or I can't be around this guy. This guy is dangerous.'”

Ramos said he knows that even if he's granted a new trial and then acquitted of the charges, the earlier convictions still will remain on his federal record. It would show he was convicted, but later exonerated.

That, he said, is still worth fighting for.

WND led the investigation into the high-profile prosecutions and convictions of Border Patrol Agents Ignacio Ramos and Jose Compean, who received 11- and 12-year sentences for slightly wounding a fleeing illegal alien drug smuggler in 2005 with a gunshot while in pursuit and in the line of duty. A federal prosecutor gave the drug smuggler full immunity to testify against the agents.

WND's in-depth coverage of the case began with the first report Aug. 7, 2006. And in the years leading up to President Bush's commutation of the agents' sentences in January 2009, WND published at least 228 news stories and 51 commentaries about the case.

Joseph Farah, editor and chief executive officer of WND, launched a petition and letter-writing campaign in late 2008 that re-focused attention on the Ramos-Compean case in the last 30 days of Bush's term.

The petition collected more than 40,000 signatures by the time Bush commuted the agents' sentences, and the letter campaign produced more than 3,000 FedEx letters to the White House.

This is Max Worthington the blogmaster.

Seconds after I had spoken to Joe Loya today about the good news of Nacho's commutation. I looked up into the sky and said "Thank You God" and there was the biggest cross I've ever seen.

It's approximately ten miles wide and twenty miles long, it appeared directly over Los Angeles Airport. This picture is looking from El Segundo CA, due north, with the Santa Monica Mountains in the background.

I captured it on my cell phone, the picture has not been altered in any way.

Our Dear Holyness, Pope Benedict,

It is with great humility and open heart that I write to you. Although there are multitudes of problems in the world, with humility I ask that you pray for the freedom of our Border Patrol Agents who were locked up on false charges. I say this because I met and spoke to Nacho and his family. He gave me his word under the oath of God that he was innocent. He was trying to protect our country against drug dealers who would go against the laws and bring drugs into this country.I am greatly saddened by this. As a past teacher and knowing how drugs get disseminated to children many of whom overdose and die, I am against drugs coming into any country and being used against the word of our Lord in the Bible.

Please pray for the families of Ramos & Campion and put in a good word to President Bush for their pardon.

These are good Catholic Mexican American Families who need your help and have suffered too long.

Another blow to the Nacho Ramos family happened the evening of 1/3/09.

Upon returning to the house with her 3 boys, her eldest son opened the front door. He was immediately hit with the smell a large amount of gas in the air, he yelled to his mom, she told him not to turn the light on. Monica safely removed her children from the area.

It is then she found her home had been broken into! Computer equipment destroyed, couches and chairs slashed, cherished wedding pictures, pictures of her life with Nacho and their children were ripped off the walls, shelves and slammed to the ground. DVDs & player taken, and the entire house ransacked! They even beat her dogs!

Thank God no one turned on a light! Monica and her three boys would be gone!!!

One has to ask, is this case related??? Is Monica getting to close to exposing the truth in this outrageous injustice to her husband and Jose Compean???

My God how much more must these families endure! These men should be home protecting their families, just as they tried to protect our Country!!!

Talk about CRUEL & UNUSUAL PUNISHMENT, Just how will Nacho even shut his eyes knowing someone attempted to blow up his family!

We must be relentless demanding The President commute the sentences of these men, return them to their families and their jobs.

Rohrabacher Leads Bipartisan Appeal To U.S. Pardon Attorney

On Behalf Of Imprisoned Border Agents

Sends Letter Officially Asking For Commutation Recommendation

Washington, DC-November 20, 2008- Today, Reps Dana Rohrabacher (R-CA) and William Delahunt (D-MA) sent an official letter to U.S. Pardon Attorney Ronald Rogers, asking for his recommendation to the President for commutation for wrongly imprisoned Border Patrol Agents Ignacio Ramos and Jose Compean. Several Congressional appeals have been sent directly to the President in the past, however, this is the first attempt to voice support through the “official process.”

“Ramos and Compean have been living in the torture of solitary confinement for almost two years for something they never should have been prosecuted for in the first place,” said Rohrabacher. “We are pleading with the Pardon Attorney to make a favorable recommendation of commutation to the President so he can finally do the right thing by these men and their families. “Mr. President, don’t leave Ramos and Compean behind as you leave the White House.”

Ramos and Compean are currently serving 11 and 12 years sentences, respectively. The letter focuses on the misapplication of 18 U.S.C 924 (c), “discharge of a firearm in commission of a crime of violence,” which was stacked on top of lesser charges and carries a mandatory 10 year minimum sentence.

“Although the punishment was set by Congress, we believe the application of 18 U.S.C 924 (c) in the case of Ramos and Compean is outside its original legislative intent,” states the letter. “The legislation’s chief sponsor…specifically stated during debate in 1968 that §924 (c) was intended to ‘persuade the man who is tempted to commit a federal felony to leave his gun at home.’ Clearly, law enforcement officers should not leave their guns at home, rather they are required to carry them and permitted to discharge their weapons in the line of duty when warranted.”

The letter also points out that U.S. Attorney Johnny Sutton, whose office prosecuted the agents, has stated his concerns with the harshness of the sentences.

H. Con. Res. 267, a resolution with the same commutation request, has also been introduced with a current list of eighty two bipartisan co-sponsors.

Dana Rohrabacher (R-CA) and William Delahunt (D-MA) will be leading a press conference to announce a bipartisan letter to the U.S. Pardon Attorney asking for commutation of sentence for unjustly imprisoned Border Patrol Agents Ignacio Ramos and Jose Compean. The agents are currently serving 11 and 12 year prison sentences, respectively, for shooting and wounding a self -admitted illegal alien drug smuggler. Both men have already spent almost two years in solitary confinement. Thus far, eighty-two Members of Congress, representing the entire political spectrum, have signed on to H.Con. Res 267 in support of commutation.

Members will discuss the injustices of the case, as well as, the misapplication of 18 U.S.C. 924(c), “the unlawful discharge of a firearm in commission of a crime of violence,” which placed a mandatory minimum 10 year sentence onto the agents’ convictions.

In 2005, during a failed drug smuggling attempt these men were involved in a shooting resulting in the wounding of an admitted drug runner from Mexico. For doing their jobs, defending our border, and capturing a van loaded with over 700 pounds of marijuana, these agents were sent to federal prison for 11 and 12 years.

Join us in assisting their families.

Registration for the run is from 7 to 10am at Tosos Sports Bar & Grill, 2401 W. Union Hills Drive. Admission is free, but we are asking for donations to help the Ramos and Compean families. There will be breakfast provided at no charge.

The run will leave promptly at 10am. We will ride to the state capitol at 17th Ave and Jefferson for surprise guest speakers. Once the speakers have finished there will be a road march of bikes and cars heading up I-17. We will ride past the federal prison at the Pioneer Rd exit where Nacho Ramos is currently being held.

The ride will end at the Roadrunner Saloon in New River. Live music, raffles, vendors, and discounted food will be provided.

28 days after a Federal Judge ruled that Caltrans did "irreparable harm" to the Constitutional rights of the San Diego Minutemen by unlawfully revoking our legal adopt-a-highway permit, thereby squelching our free speech, Caltrans finally put our sign back up today that they had ripped out of the ground literally in the middle of the night on Jan. 28th.

We are all thrilled to see our adopt-a-highway recognition sign back up standing more proudly than ever. The U.S. Constitution has thankfully trumped the lies and coercion of the illegal alien activists and the corrupt California Mexican Caucus, especially Assemblymember Lori Saldana who joined forces with Enrique Morones late last year to wage a destruction crusade against the fine, multi-ethnic Patriots of the San Diego Minutemen. Her malicious lies have been exposed for the judge and the world to see!

Judge Hayes also saw clear evidence that even the Mexican Government, via their Consulate in San Diego and agents like Morones who works for the Mexican Govt., put pressure on Caltrans to violate their own rules and the American Constitution, which District Director Pedro Delgado and Director Will Kempton then caved in to (see attachment).

We've all won a huge battle against the open border reconquistas and their agents in elected office, but the war is not over. Caltrans has still not given us our second AAH site on southbound I-5 that they unlawfully denied to us on May 15th. They are obviously still trying to please Saldana, Gil Cedillo and their ilk rather than follow their own written regulations and the LAW! We will be asking them one more time, nicely to give us that site or we will haul them back into Federal Court where will again hold them accountable for their deeds.

Also, the entire program is still suspended for new applicants while they continue to attempt to rewrite their regulations to exclude pro-law enforcement and border security groups from participating. That will never pass Constitution muster either. They are just wasting time and millions of precious taxpayer dollars. This long suspension is also leaving many California highways uncleaned or having to hire work crews to clean them. Gov. Schwarzenegger needs to get control of our state now, before the pro-alien liberals and special interest groups in Sacramento destroy it completely.

Thank you to Americans nationwide who helped us win this critical legal fight for our rights and to have our message heard by all America!

Judicial Watch Sues State Department to Obtain Documents Related to Jailed Border Patrol Agents

Regular readers of the Weekly Update will remember the names Ignacio "Nacho" Ramos and Jose Alonso Compean. They are the two Border Patrol agents shamelessly prosecuted by the U.S. government for shooting and wounding a Mexican drug smuggler, Oswald Aldrete-Davila, on February 17, 2005. (The two Border Patrol agents were sentenced to 11 and 12 years respectively. Aldrete-Davila, who attempted to smuggle 750 pounds of marijuana into the U.S., was given medical treatment and immunity for his testimony.)

Well, on June 12 Judicial Watched filed a lawsuit against the Department of State to obtain documents related to the government's decision to prosecute Ramos and Compean and to strike a deal with Aldrete-Davila for his testimony. Judicial Watch filed its original FOIA request on April 17, 2008. The government failed to respond within the statutory 20-day period, forcing us to file our lawsuit.

(Incidentally, this is the second FOIA lawsuit filed by Judicial Watch related to the jailed Border Patrol agents. Click here for more information.)

Here's essentially what we're after in this lawsuit.

Information pertaining to government deals that were made with the government of Mexico to bring Aldrete-Davila to the U.S. to testify.

Any internal communications between the State Department, the Department of Homeland Security and the Justice Department related to the decision to permit the lawful entry of Aldrete-Davila into the U.S. for medical treatment and for meetings with government prosecutors.

Any and all records of the Diplomatic Security Services (a branch of the State Department) related to the shooting incident.

There is enormous public interest in this incident. Many people, myself included, suspect these Border Patrol Agents were railroaded by the government for simply doing their jobs. Given the controversy surrounding the case, the more the American people know, the better.

We continue to aggressively pursue documents related to the incident, and I will keep you posted on what we find.

In a letter this week to the U.S. Department of Justice, Representative Walter B. Jones (R-NC) – joined by Reps. Ted Poe (R-TX), Virgil Goode (R-VA), Louie Gohmert (R-TX), John Culberson (R-TX), Dana Rohrabacher (R-CA) and Don Manzullo (R-IL)

– requested that the Office of Professional Responsibility investigate the actions of U.S. Attorney Johnny Sutton in the prosecution of U.S. Border Patrol agents Ignacio Ramos and Jose Alonso Compean. The agents entered federal prison on January 17, 2007, to begin serving sentences of 11 and 12 years respectively for shooting and wounding a Mexican drug smuggler who brought 743 pounds of marijuana across the U.S. border in 2005. Excerpts from the letter follow below.

“As Members of Congress, we write this letter to bring to your attention for investigation what we have concluded to be a serious miscarriage of justice by United States Attorney Johnny Sutton. Mr. Sutton supervised, and has vigorously defended, his office’s actions in a case wherein two United States Border Patrol agents – Ignacio Ramos and Jose Alonso Compean — have been convicted, and each are now being punished by imprisonment of 10 years, for a crime that does not exist, and therefore, for a crime that could not have been committed.” “Specifically, Mr. Ramos and Mr. Compean were charged with violating 18 United States Code Section 924(c)(1)(A) by the ‘knowing[] discharge[] [of] a firearm ... during and in relation to a crime of violence.’ (Emphasis added). There is, however, no such crime. Rather, Section 924(c)(1)(A) makes it a crime to ‘use or carry ... during and in relation to any crime of violence’ or to ‘possess a firearm’ ‘in furtherance of’ any such crime.

And, as the United States Supreme Court recently pointed out, ‘discharge’ is only a sentencing factor to be considered by the judge after conviction, not by the jury in the effort to determine whether the law has been violated. United States v. Watson …(2007).” “United States Attorney Sutton secured an indictment charging Mr. Ramos and Mr. Compean with the non-existent crime of ‘discharging’ a firearm ‘in relation to a crime of violence.’

By this charge Mr. Sutton facilitated the conviction of the two border control agents by means of jury instructions that focused the jury’s attention upon the ‘discharge’ of the agents’ firearms, rather than upon the lawfulness of the possession, carrying, and use of such firearms in the ordinary course of their employment. Moreover, by this indictment and these instructions,

Mr. Sutton obtained a conviction of an offense that carried a minimum 10-year sentence, as provided by the statute, rather than the lesser-sentence for violation of Border Patrol rules and regulations.”

“It is our firm conviction that, by these actions, Mr. Sutton is guilty of prosecutorial misconduct, which has imposed an irreversible and substantial effect upon Mr. Ramos and Mr. Compean and their families. Prior to the return of the indictment against Mr. Ramos and Mr. Compean,

Mr. Sutton must have known that it was impossible for there to be probable cause for a ‘crime’ never enacted by Congress, as authoritatively and previously decided by the United States Supreme Court and the United States Court of Appeals for the Fifth Circuit.

According to Rule 3.09 of the Texas Disciplinary Rules of Professional Conduct, a prosecuting attorney is to ‘refrain from prosecuting ... a charge that the prosecutor knows is not supported by probable cause.’”

“Mr. Sutton has manipulated the federal criminal code to obtain a conviction against two U.S. Border Patrol agents, preferring to win at all costs over his duty as a United States Attorney, and his duty under the Texas Rules of Professional Conduct. This is a matter which your office has a duty to investigate and, on the basis of what we now know, to remedy.”

Many congressman wont lift a finger for you if your not in their district, but Congressman Rohrabacker is one of the leaders in getting these two men released

Monica & Nacho's youngest son, has been hospitalized. Currently tests are being run so there has not been an absolute diagnosis, however hospital professionals are suspecting meningitis.

The hospital almost denied J's admittance since Monica does not have health insurance (a status of many Americans today). Monica of course is fierce! And she asked the hospital "How do you admit the illegals?" After some debate, the hospital did admit J, but demanded a $1000 deposit. Funds the Ramos family simply does NOT have at this time.
